Millbrook man sentenced to 99 years for rape 20 years agoPublished 12:57pm Thursday, June 20, 2013
A Millbrook man likely could spend the rest of his life in prison after being found guilty of first-degree rape Thursday morning.
Gary H. Jones, 41, was found guilty of first-degree rape by an Elmore County jury and sentenced to 99 years in jail in a case which is more than 20 years old.
Jones was arrested and charged with three counts of first-degree rape and seven counts of first-degree sodomy when he was a teenager sometime between 1987 and 1990.
Jones’ victims were 11, 10 and 7 years old at the time and all were his relatives, according to court records.
“It was a very difficult case, but we are pleased with the outcome and Judge (Sibley) Reynolds’ sentence,” said Kristy Peoples, who prosecuted the case for the 19th judicial circuit
In November 2011, he pleaded guilty and was sentenced to 20 years in jail.
But his attorney questioned whether he should have been tried as a youthful offender instead of an adult.
In January 2012, his attorney withdrew the guilty plea and challenged the ruling.
District Attorney Randall Houston had to file a motion to have Jones certified as an adult and have the case presented to a new grand jury.
After Jones was indicted, he got his trial date.
The jury found Jones guilty of one count of first-degree rape and was hung on the remaining nine counts.
Jones’ attorney waived his sentencing date and asked Reynolds to sentence his client following the verdict.
